These terms of service (“Terms of Service”) are a binding agreement between the party accepting these Terms of Service and/or accessing this website (“you”) and Data2Go Wireless, Inc.. References herein and throughout the website and these Terms of Service to “MyData2Go”, “we”, “our” or “us” refer to Data2Go Wireless, Inc..

If an individual is accessing the website and service on behalf of a business entity, by doing so, such individual represents that they have the legal capacity and authority to bind such business entity to these Terms of Service. The term “you” shall refer to both the business entity and the individual accessing the service on behalf of such business entity.

Applicability of the Terms of Service: These Terms of Service govern your purchase, access to, receipt of and use of MyData2Go wireless internet access service (the “Service”). The Service includes your purchase of an internet access router (the “Hardware”) and access to the website at https://myd2g.com (the “Website”).

Authorized use of the Service: The Service is solely for your personal use or use in a home. office You may not use the Service to enable internet access in any publicly accessible location. You assume responsibility for any user accessing the internet through the Service as if such acts were committed by you. Your use of the Service is subject to these Terms of Service and all applicable laws, rules and regulations. You may not resell use of, or access to, the Service to any third party without our prior written consent.

Registration and Passwords: In order to maintain an account with MyData2Go, you may be required to provide specific information. All information about you must be truthful, and you may not use any aliases or other means to mask your true identity. Any access codes or passwords provided should be safeguarded at all times. You are responsible for the security of your access codes and passwords and will be solely liable for any use or unauthorized use under such access codes or passwords.

Initiating Service: You can initiate Service by placing an order through our Website. Upon our acceptance of your order, which is at our sole discretion, we will send you the preconfigured Hardware. Upon receipt of the Hardware, you must scan the QR Code on the back of the Hardware to initiate and complete the setup of the Service. Service is initiated, and the Initial Term (defined below), commences when your device is shipped and a tracking number is generated.

Bandwidth: You may use up to 1 terabyte (TB) of data per monthly billing cycle. If you exceed 1 TB, MyData2Go may suspend your Service as set forth herein and/or require you to purchase additional bandwidth.

Term: The Service is for an initial and non-cancellable term of 24 months (“Initial Term”), unless terminated, suspended or cancelled solely as set forth in these Terms of Service. After the Initial Term, the Service shall renew on a month-to-month basis until cancelled by either party as set forth herein.

Payments & Recurring Charges: There is no charge to you for the Hardware, provided that you pay all fees for the entire Initial Term. The prices charged by MyData2Go will be those in effect on the date of receipt of your order. You agree to pay MyData2Go for all charges at the prices then in effect, and you authorize MyData2Go or its designated payment processor to automatically charge your payment provider using the payment details you have provided each billing period for the Service. All payments are to be made in United States Dollars. Posted prices do not include sales tax, which will be charged to you when applicable. MyData2Go reserves the right to correct any errors or mistakes in pricing that it makes even if it has already requested payment. MyData2Go may offset any amounts owed to you against amounts due to us. MyData2Go reserves the right to charge interest for any overdue or declined charges at a rate of the lesser of one and one-half percent (1.5%) per month or the maximum rate allowable by applicable law. You agree to reimburse MyData2Go for all costs or expenses of MyData2Go in collecting any amounts due herein or to enforce these Terms of Service (including attorney’s fees and expenses).

Cancellation – 7 Day Trial: You may cancel the Service for any reason within the first 7 days after commencement of the Initial Term. To exercise this right, you must contact MyData2Go at support@myd2g.com to verify the request and receive an RMA number. Upon approval of your cancellation, we will send you a return label and shipping instructions. You will not be obligated to pay the initial month for the Service. If such fee has already been charged, we will credit the amount back to you. However, you must pay a $30 restocking fee. The Hardware must be returned in good working order without any damage (including scratches or dents), together with all packaging, boxes, accessories, documentation and other items provided to you in good working order as well.

Termination & Suspension: Either party may terminate the Service if the other party is in breach of these Terms of Service and does not cure such breach within five (5) business days of written notice. MyData2Go may suspend your Service at any time if you are in breach of these Terms of Service or to protect MyData2Go or any third parties from liability. MyData2Go shall make reasonable efforts to provide you with advance notice of any suspension, unless such suspension is necessary to avoid any material or immediate harm. If your Service is terminated prior to completion of the Initial Term, you must pay MyData2Go $25 per month for the balance of the remaining Initial Term. For any permitted termination or suspension of the Service, MyData2Go may do so remotely. Suspended Service will be reinitiated promptly after the cause of such suspension has been fully rectified. In the event of any termination, you may retain the Hardware, though the Service will no longer be operational.

Support & Maintenance: MyData2Go provides limited support, maintenance, training and repair services (“Support”). To receive such services, you may contact us at 855-Data2go/855-326-2246, option 2 or email support@myd2g.com. If any needs are due to your errors, fault or negligence, MyData2Go reserves the right to bill you at our standard hourly rates for such services.

Corrections: We attempt to be as accurate as possible and eliminate errors on the Website; however, we do not warrant that any product or description, photograph, pricing or other information is accurate, complete, reliable, current, or error-free. In the event of an error, whether on the website, in an order confirmation, in processing an order, delivering a product or otherwise, we reserve the right to correct such error and otherwise change or update the information on the website at any time without notice, revise your order accordingly if necessary (including charging the correct price) and/or cancel your order and refund any amount charged.

Acceptable Use Policy: You must use the Service in compliance with these Terms of Service; all applicable laws, rules and regulations; and the Verizon Wireless Acceptable Use Policy (https://www.verizon.com/about/terms-conditions/acceptable-use-policy). Without limiting the foregoing, you may not use the Service to access, upload or transmit any content that:

is defamatory, abusive, obscene, profane or offensive;
infringes or violates another party’s intellectual property rights (such as music, videos, photos or other materials for which you do not have written authority from the owner of such materials to post on the Website);
violates any party’s right of publicity or right of privacy;
is threatening, harassing or that promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
promotes or encourages violence;
is inaccurate, false or misleading in any way, or constitutes impersonation of another person;
is illegal or promotes any illegal activities;
promotes illegal or unauthorized copying of another person’s copyrighted work or links to them or providing information to circumvent security measures;
contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; or
contains any advertising, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation.

MyData2Go is under no obligation to screen or monitor content or information transmitted through the Hardware.

Proprietary Rights: MyData2Go is the owner of or otherwise licensed to use all parts of the Service, including all copy, software, graphics, designs and all copyrights, trademarks, service marks, trade names, logos, and other intellectual property or proprietary rights contained on the Website. By using the Service, you agree not to copy, distribute, modify or make derivative works of any materials without the prior written consent of the owner of such materials. Except as expressly set forth in these Terms of Service, no license is granted to you and no rights are conveyed by virtue of accessing or using the Service. All rights not granted under these Terms of Service are reserved by MyData2Go.

Privacy: MyData2Go does not receive any of the content and information that you transmit or access through the Hardware. We are able to remotely access the Hardware for purposes of maintenance and support, and to exercise our rights under these Terms of Service. MyData2Go will receive personal data from you when you sign up to use the Service. We process personal information as set forth in our https://data2gowireless.com/privacy-policy-2/

Warranty: MyData2Go agrees to provide the Service in accordance with these Terms of Service and in compliance with all laws, rules and regulations that apply to MyData2Go. Your sole remedy for any breach of the foregoing warranty is to terminate the Service as set forth in these Terms of Service.

No Liability for Hardware Provider: The Hardware is manufactured by, and the wireless access is provided by, a third party internet service provider (the “ISP”), currently Verizon Wireless. You acknowledge that we do not control the ISP, and that the ISP may experience downtime, outages, maintenance periods, coverage failures and other events that degrade or interfere with your intended use of the Service. In addition, the ISP may cease providing internet access altogether. MyData2Go is not liable for any act or omission of the ISP, including the failure of the ISP to maintain appropriate security, loss of data or access to inappropriate content. MyData2Go may change the ISP at any time.

No Liability for Matters Outside of MyData2Go’s Control: MyData2Go shall not be in breach of these Terms of Service or responsible for damages caused by delay or failure, in full or in part, of its obligations hereunder, provided that there is due diligence in attempted performance under the circumstances and that such delay or failure is due to circumstances substantially beyond the control of MyData2Go, including act of God, failure of telecommunications systems, strikes, government sanctioned embargo, act of war or terrorism, act of any public authority or sovereign government, civil disorder, delay or destruction caused by public carrier.

Disclaimer: WHILE MYDATA2GO USES REASONABLE EFFORTS TO INCLUDE UP-TO-DATE INFORMATION ON THE WEBSITE, MYDATA2GO MAKES NO WARRANTIES OR REPRESENTATIONS AS TO ITS ACCURACY OR COMPLETENESS. EXCEPT AS EXPRESSLY SET FORTH IN THESE TERMS OF SERVICE, THE SERVICE IS PROVIDED “AS IS” AND MYDATA2GO MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND WHATSOEVER. FURTHER, TO THE FULLEST EXTENT PERMISSIBLE BY LAW, MYDATA2GO DISCLAIMS ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, NON-INFRINGEMENT, TITLE, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. MYDATA2GO DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVER THAT MAKES IT AVAILABLE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. IN NO EVENT WILL MYDATA2GO BE LIABLE UNDER ANY THEORY OF TORT, CONTRACT, STRICT LIABILITY OR OTHER LEGAL OR EQUITABLE THEORY FOR ANY LOST PROFITS, LOST DATA, LOST OPPORTUNITIES, COSTS OF COVER, EXEMPLARY, PUNITIVE, PERSONAL INJURY/WRONGFUL DEATH, SPECIAL, INCIDENTAL, INDIRECT OR OTHER CONSEQUENTIAL DAMAGES.
MYDATA2GO’S LIABILITY TO YOU FOR ANY DIRECT DAMAGES SHALL BE LIMITED TO THE FEES PAID BY YOU TO MYDATA2GO DURING THE PRIOR SIX (6) MONTHS.

If any part of these warranty disclaimers or limitations of liability is found to be invalid or unenforceable for any reason or if we are otherwise found to be liable to you in any manner, then our aggregate liability for all claims under such circumstances for liabilities, shall not exceed the amount paid by you, if any, for accessing the Service.

Waiver By California Residents: IF YOU ARE A CALIFORNIA RESIDENT, YOU HEREBY WAIVE CALIFORNIA CIVIL CODE SECTION 1542 IN CONNECTION WITH THE FOREGOING, WHICH STATES: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR.”

Changes: All information posted on the Website is subject to change without notice. In addition, these Terms of Service may be changed at any time without prior notice, provided that, such changes will not modify your use of the Service during the Initial Term. We will make such changes by posting them on the Website. You should check the Website for such changes frequently. Your continued access of the Website after such changes conclusively demonstrates your acceptance of those changes.

Indemnification: You agree to indemnify, defend and hold harmless MyData2Go, its employees, directors, officers, agents, business partners, affiliates, contractors, distribution partners and representatives from and against any and all claims, demands, liabilities, costs or expenses, including attorney’s fees and costs, arising from, or related to, (i) any breach by you of any of these Terms of Service or applicable law or (ii) your use of the Service.

Severability. If any part of these Terms of Service shall be held or declared to be invalid or unenforceable for any reason by any court of competent jurisdiction, such provision shall be ineffective but shall not affect any other part of these Terms of Service, and in such event, such provision shall be changed and interpreted so as to best accomplish the objectives of such unenforceable or invalid provision within the limits of applicable law or applicable court decisions.

Waiver; Remedies: The failure of MyData2Go to partially or fully exercise any rights or the waiver of MyData2Go of any breach of these Terms of Service by you shall not prevent a subsequent exercise of such right by MyData2Go or be deemed a waiver by MyData2Go of any subsequent breach by you of the same or any other term of these Terms of Service. The rights and remedies of MyData2Go under these Terms of Service and any other applicable agreement between you and MyData2Go shall be cumulative, and the exercise of any such right or remedy shall not limit MyData2Go’s right to exercise any other right or remedy.

Governing Law: These Terms of Service shall be governed by the laws of the State of Florida. You consent to the exclusive jurisdiction and venue of the courts located in Broward County, Florida for all matters in connection with the Service.
